Terms of Service

Client and Dog Trainer Agreement:

From this point forward, the person purchasing products and services from Happy Hound will be referred to as the Client. The pronoun “I” in this contract is referring to the Client in first person.

The trainers, employees, contractors, and assigns of Happy Hound will be further referred to as “Happy Hound”, “Happy Hound Dog Obedience” and or “the trainer”.

I understand that, despite Happy Hound Dog Obedience’s best efforts to maintain the safety of every dog and human at Happy Hound Dog Obedience facilities, there are certain risks involved in dog training.  These risks include but are not limited to my dog contracting fleas, kennel cough or some other communicable illness.  I voluntarily accept these risks, and release Happy Hound Dog Obedience and its employees, independent contractors, owners and assigns from any and all claims arising out of injury or damage in any way related to or resulting from my association with Happy Hound Dog Obedience, including but not limited to claims of injuries to my dog, myself or to any property that belongs to me. I understand and agree that dogs can be unpredictable and that if my dog becomes injured while at Happy Hound Dog Obedience training I will be responsible for my dog’s veterinary bills and any other costs incurred due to the injury.  I understand and agree that this release applies to future unknown or unsuspected claims. I also acknowledge that Happy Hound Dog Obedience does not give full refunds on training due to inadvertent injuries and illnesses.

I represent that my dog is currently in good health and has not had any communicable illness of any kind for two weeks prior to attending Happy Hound Dog Obedience training programs.  I will wait ten days before bringing my dog to Happy Hound Dog Obedience after any dog kennel overnight.  I further represent that each time I bring my dog to Happy Hound Dog Obedience, I am re-certifying that my dog is in good health and has not had any communicable illness of any kind for two weeks prior to such attendance.   

 

All media (pictures, videos, etc.) at Happy Hound Dog Obedience are the property thereof. I agree that as part of this program myself or my dog may be photographed. These images may be used in digital or physical marketing products Happy Hound Dog Obedience creates. Any client who wishes not to be photographed must inform Happy Hound Dog Obedience in writing (email is sufficient).

I understand that this contract also applies to any affiliates or facilities that Happy Hound Dog Obedience may utilize during the training course including, but not limited to the landlord or property manager of a trainer’s home or facility, parks owned by the county, local businesses, etc.

 

 

TERMINATION OF TRAINING AND REFUNDS

For all training programs or packages:

The owner of the dog(s) may have the dog withdrawn from training at any time, however, certain conditions will apply in terms of refunds. For dog training services to be successful in improving a dog’s behavior, the dog’s owner must be committed to making lifestyle changes and making time in their day to exercise, play with, and train their dog. A client’s dog must also be in good health and of sound genetics for training to have the most positive effects. Happy Hound cannot guarantee that any client will be cooperative during the training process. Happy Hound also has no control over unforeseen circumstances such as unexpected death or illness in the family (including the dog) or change in the clients’ circumstances, or the client deciding to euthanize or rehome of their dog. Because of the nature of dog training classes, it is for this reason that refunds for training will be given entirely at Happy Hound’s discretion and refunds are not guaranteed in any situation where training has already begun.

Prior withdrawal refunds are as follows: Due to the cost and nature of Happy Hound’s training program, acquiring new clients is an expensive and time-consuming process. As result, Happy Hound has a very strict cancellation policy.

  • The client may withdraw from any of the following programs up to 7 days after signing this contract to receive a full refund on training.

  • Private Coaching: The client must cancel within the above timeframe to receive a full refund. The client then has up to 48hrs before their second training appointment to receive a full refund after a 25% cancellation fee. After that, all fees are non-refundable.

  • Bootcamp: The client must cancel within the time frame stated above to receive a full refund. Once the 7-day period has passed, the client may cancel up to 30 days before drop-off and receive a refund after a 25% cancellation fee. Once the drop-off date is 14 days away, that cancellation fee increases to 50%. Once the dog is in Happy Hound’s care, all fees are non-refundable.

  • Group Classes: The client must cancel within the time frame stated above to receive a full refund. After this, any client may drop from the class up to 24hrs before the initial start date and receive refund after a 25% cancellation fee. Once training has begun, all fees are non-refundable.

  • Evaluations/Consultations: It is a typical business practice across many industries for an evaluation/consultation fee to be nonrefundable. However, Happy Hound graciously gives patrons 30 days to request a refund on a consultation fee. This fee may be applied to a total training cost on private coaching or bootcamp at any time or be refunded within the 30-day window if the client decides not to hire Happy Hound. The evaluation fee cannot be applied to charges for any group class. After the 30-day period, the fee is non-refundable.

  • Once the Client has surpassed the grace periods stated above, all fees are non-refundable.

  • All request for refunds must be made in writing and sent to Happy Hound via email, text or snail mail.

  • It is the client’s responsibility to ensure they meet their deadline for any refunds and Happy Hound is not responsible for reaching out to the client to remind them of said deadlines.

Happy Hound dog trainers and staff have the right to refuse services or terminate a client at any point without refund for non-compliance, lack of participation, apathy and lewd, violent or argumentative behavior.

Happy Hound is not responsible for refunds on training for circumstances outside of their control that would include but are not limited to instances of natural disaster, global pandemics, or economic recession/collapse.

The Client recognizes the aforementioned investment, up-front sales, setup, and opportunity costs that Happy Hound Dog Obedience bears in connection with their commitment to provide you this service, and acknowledges that this fee is not a penalty, but rather a reasonable amount of liquidated damages to compensate Happy Hound and it’s contractors, employees or assigns for early cancellation of the Services.

If the client believes that Happy Hound's services have been unsatisfactory, Happy Hound's supervisor will work with the client to come to an amicable solution that may or may not include refunds.

SCHEDULING POLICY

A card will be kept on file or all training clients. All clients are allowed 2 canceled/rescheduled appointments without penalty. After that, each cancellation/reschedule/no-show within 24hrs of the appointment will incur a $75 fee or loss of one appointment within their package. If the client elects not to reschedule the appointment or pay the fee, then they acknowledge that there are some concerns with their dog that may not be addressed due to time constraints. Clients participating in group classes are not subject to this scheduling policy but are not entitled to refunds of any kind for lack of participation.

LIABILITY 

I, as the legal owner/agent of the abovementioned pet(s), having carefully read and fully understand this agreement, do hereby waive and release Tara Siefring, Happy Hound Dog Obedience and affiliates from any and all liability of any nature.  This includes any injury, death, sickness or damages my pet may suffer during or after any training program.  I also agree to indemnify and hold harmless Tara Siefring, Happy Hound Dog Obedience and affiliates from any and all claims due to damage the pet may cause to any family members of any third parties during or after training.  The owner specifically acknowledges that they recognize the risk of dog training with other people and their dogs.

OVERNIGHT STAYS

All dogs must be healthy, up to date on shots, and be on a monthly flea/heartworm preventative to stay overnight at the Happy Hound facility or any trainer’s home or place of business. Happy Hound has the right to terminate training without a refund for failure to follow these instructions. If the client leaves their dog at Happy Hound without payment, we hold all rights to consider your dog abandoned after 14 days and release them to an animal rescue or shelter for rehoming.

TRAINING RESULTS

A dog trainer cannot guarantee the behavior of any living animal. Training does not guarantee that your dog will remain trained and well-behaved after any training program. Your results will differ depending on the commitment you put into enforcing our training methods into your everyday life with your dog during and after the program. Other factors also play a role including your dog's health, genetics, and home environment. Happy Hound does not write letters of recommendation to vet’s offices, animal control, hospitals, hotels or landlords on behalf of the client if their dog has had any behavioral history that Happy Hound and it’s assigned would consider a safety concern for the public.

TRAINING TOOLS

Tools and techniques for training can include the use of prong collars, bark collars, e-collars, martingales, slip leashes, and muzzles. The client is responsible for purchasing all training equipment whether that cost is included in a service package or is sold separately. Any lost, stolen or broken training tools must be addressed with the product manufacturer. Happy Hound Dog Obedience is not responsible for replacing damaged equipment. Happy Hound Dog Obedience is not responsible for any physical or psychological damage inflicted upon an animal or person from uneducated, negligent or irresponsible use of these training tools.

TRIALS AND TRAINING SUBSCRIPTIONS

The client acknowledges that Happy Hound Dog Obedience conducts their trial and subscription training options to the like of any other professional service with a monthly fee. The Client is required to have a card on file that will be charged automatically. The Client is responsible for utilizing the service that is offered for this fee. Happy Hound trainers and staff will not be responsible for making sure the client redeems appointments on a subscription plan. Prices of subscription plans vary and are subject to change. There are no refunds for trials or training subscriptions. The client is responsible for purchasing the training tools that Happy Hound recommends.

SATISFACTION AND SERVICE FULFILLMENT

Happy Hound Dog Obedience guarantees that the services rendered will be of the best quality Happy Hound can provide and will result in a reasonable improvement on the dog's behavior in conditions where the dog is of sound health and genetics and the client commits to training practices. The client acknowledges that their dog is an animal and may commit behaviors outside of human control. This includes but is not limited to liable accidents, disobedience on the dog's behalf due to environmental factors, laws of mother nature, etc. The client understands that when rehabilitating an aggressive dog Happy Hound cannot guarantee a dog will never become aggressive again or do any harm to a third party or their property. The client also understands that the sources of dog aggression may root from unknown genetic or medical issues that Happy Hound, is not aware of or responsible for. If a medical or genetic issue is found to be the cause of the dog’s behavioral issues, Happy Hound will continue to provide expert advice while helping the client make decisions about their dog’s future (euthanization, medical intervention, rehoming etc), but will not be liable for the dog's actions or the client’s decisions made in guardianship of the dog and no refunds on training will be given. Advice for ill and genetically flawed dogs is only meant to serve as guidance for the client during a difficult time based on the trainer's previous experience. Happy Hound's guidance during this time is not meant to take the place of medical, veterinary or legal advice. These unpredicted events/behaviors do not make Happy Hound liable to refunds for training. The client understands that what they are paying for and what is guaranteed expert advice and expert advice only. I understand that my satisfaction and any guarantees only apply to the services Happy Hound has provided to me, not to my dog's current or future behavior. Happy Hound may occasionally grant prorated or full refunds in cases of moral obligation, but per contract are not required to pay me any refund on training after training has begun.

 

This training agreement is permanently binding and represents the full and only agreement between the parties. The terms and conditions set forth in this agreement cannot be modified or changed in any way unless agreed to by both parties in writing.
